MCCUMBER DANIELS’ PENNSYLVANIA OFFICE SECURES DISMISSAL OF CLIENT FROM LONG TERM CARE MATTER

Columbia County, Pennsylvania—

McCumber Daniels attorney Stuart T. O’Neal secured the dismissal of a long term care client, from a matter that alleged substandard nursing home care over a number of years that included allegations of outrageous a conduct and a prayer for punitive damages. The allegations involved included:

1. Not adequately staffing;
2. Failure to provide the required breathing treatments in a timely matter;
3. Failure to turn;
4. Failure to administer medication;
5. Failure to elevate;
6. Failure to maintain the resident’s tracheotomy;
7. Falsification of documentation; and
8. Failure to supervise.

The Honorable Charles H. Saylor presided over the matter, which involved procedural issues such as the sufficiency of the Plaintiffs’ Certificate of Merit.
