McCumber Daniels Attorneys Secure Final Summary Judgment Dismissing Case Against Tampa General Hospital on Eve of Trial
The collective efforts of shareholder Kenneth Puig and associate Kari Aasheim resulted in summary judgment for McCumber Daniels client Tampa General Hospital on the eve of trial. The medical negligence claim involved an orthopedic trauma patient who received emergency surgery to repair multiple bone fractures and other internal injuries sustained in a motor vehicle accident.
After several months of inpatient care and follow-up surgical procedures, and despite the best efforts of the hospital, the patient underwent amputation of a limb which was critically injured in the accident. After nearly five years of discovery, including multiple depositions of expert witnesses for both parties, the plaintiffs could not produce evidence to establish that acts or omissions of Tampa General Hospital caused or contributed, in any way, to the loss of the patient’s limb. The case was dismissed after attorneys Puig and Aasheim prepared and presented a Motion for Final Summary Judgment, persuading the trial court that the medical negligence claim against Tampa General Hospital should not be submitted to a jury.
